{"id":41112,"date":"2026-04-15T15:58:38","date_gmt":"2026-04-15T19:58:38","guid":{"rendered":"https:\/\/carfms.org\/?p=41112"},"modified":"2026-04-15T16:02:21","modified_gmt":"2026-04-15T20:02:21","slug":"the-us-trump-administrations-unlawful-anti-refugee-and-migrant-policies","status":"publish","type":"post","link":"https:\/\/carfms.org\/fr\/the-us-trump-administrations-unlawful-anti-refugee-and-migrant-policies\/","title":{"rendered":"The US Trump Administration\u2019s Unlawful Anti-Refugee and Migrant Policies"},"content":{"rendered":"\n<p>Since US President Donald Trump started his second term in office, he has been systematically dismantling the United States&rsquo; asylum system and violating the fundamental human rights of refugees. For example, <a href=\"https:\/\/www.rescue.org\/article\/how-have-trump-policies-impacted-refugees\">the Trump Administration has suspended the US refugee resettlement program, set the lowest refugee admission cap ever and introduced travel bans for those who may be seeking asylum from a number of countries<\/a>. In addition, the Trump Administration has expanded deportations dramatically across the United States. Immigration and Customs Enforcement (ICE) has been instructed to meet a quota of 3,000 arrests per day.&nbsp;This has resulted in violent raids and arrests of people, including children, taking place in workplaces, schools, and in communities across the United States. <a href=\"https:\/\/www.theguardian.com\/us-news\/2026\/jan\/28\/deaths-ice-2026-\">ICE agents have been responsible for the death of eight people over the past year, including Renee Nicole Good and Alex Pretti in Minnesota.<\/a> Indeed, UN experts in human rights have welcomed the establishment of a process to document and report serious human rights violations committed allegedly in Minnesota, and further noted, that, \u201c<a href=\"https:\/\/www.ohchr.org\/en\/press-releases\/2026\/03\/usa-un-experts-welcome-minnesota-truth-seeking-entity-and-urge-nation-wide\">Documenting, seeking the truth and ensuring accountability for serious human rights violations is not optional \u2026. It is a legal obligation and a prerequisite for justice and guarantees of non\u2011repetition.<\/a>\u201d<\/p>\n\n\n\n<p>Immigration detention has increased tremendously with some 60,000 per day being held in inhuman conditions in makeshift camps, former military bases, and in private prisons. <a href=\"https:\/\/afsc.org\/news\/trumps-executive-orders-immigration-explained\">Over the past year, some 32 people have died in ICE custody. Further, some 100 Immigration Judges have been fired across the United States as the number of deportations have expanded rapidly. This has resulted in the denial of due process for millions of asylum seekers who are left waiting for months.<\/a> The Trump Administration has declared a national border emergency at the southern border with Mexico that has allowed the deployment of more US troops and has reinstated the \u00ab\u00a0Remain in Mexico\u00a0\u00bb policy which requires asylum seekers to wait in Mexico for their US immigration court hearings. Moreover, <a href=\"https:\/\/www.cfr.org\/articles\/ice-and-deportations-how-trump-reshaping-immigration-enforcement\">the Trump Administration&rsquo;s <em>One Big Beautiful Bill Act<\/em> provided funding of some $170 billion for immigration enforcement and border security for four years. It also capped the number of Immigration Judges to 800 despite the increased need given the growing backlog of 3.8 million cases as of June 2025.<\/a> Further, the Trump Administration\u2019s \u201cturnback\u201d policy, that block asylum seekers from entering a port of entry and denying their right to make a claim for asylum is being challenged at the US Supreme Court in the case of &nbsp;<a href=\"https:\/\/www.supremecourt.gov\/docket\/docketfiles\/html\/public\/25-5.html\"><em>Noem v. Al Otro Lado<\/em><\/a><em>. <\/em>As argued by a number of former US government officials, \u201c<a href=\"https:\/\/www.justsecurity.org\/134105\/america-turning-away-people-fleeing\/\">these practices far exceeded the requirements of border management, as the lower courts recognized, and reflected deliberate efforts to prevent people from initiating the asylum process.<\/a>\u201d<\/p>\n\n\n\n<p>The Trump Administration has clearly pivoted from the United States\u2019 historic role of being a nation of immigrants that has provided a safe refuge for asylees. It has trampled the fundamental rights of those who are seeking asylum in the United States to such a degree that <a href=\"https:\/\/www.bbc.com\/news\/articles\/c7950wvpv34o\">a recent decision of the Committee on the Elimination of Racial Discrimination (CERD) has warned that the \u00ab\u00a0racist hate speech\u00a0\u00bb used by US President Donald Trump and other US politicians has fueled human rights violations.<\/a> <a href=\"https:\/\/www.ohchr.org\/en\/press-releases\/2026\/03\/usa-racial-profiling-and-racist-hate-speech-political-leaders-heightened\">The decision under its early warning and urgent procedures notes that such rhetoric can incite racial discrimination and hate crimes. The report further emphasized that it is deeply concerned that the increased use of racist hate speech portraying asylum seekers, refugees, and migrants as criminals or as a burden is entirely unacceptable<\/a>.<\/p>\n\n\n\n<p>Given the foregoing, it is well past the time to condemn the US Trump Administration\u2019s policies and actions in breaching the human rights of the world&rsquo;s most vulnerable persons, refugees, and to join the voices of others who have raised serious concerns, including <a href=\"https:\/\/carfms.org\/carfmss-statement-on-the-current-state-of-world-affairs-in-support-of-refugee-rights\/\">CARFMS<\/a>, <a href=\"https:\/\/ccrweb.ca\/en\/ccr-statement-solidarity-and-concern-regarding-mobilization-and-attacks-minnesota-and-us\">the Canadian Council for Refugees<\/a>, &nbsp;<a href=\"https:\/\/www.amnesty.org\/en\/latest\/news\/2026\/01\/usa-one-year-into-president-trumps-return-to-office-authoritarian-practices-are-eroding-human-rights\/#:~:text=USA:%20One%20year%20into%20President,%2C%20and%20human%20rights%20defenders.%E2%80%9D\">Amnesty International<\/a>, <a href=\"https:\/\/www.hrw.org\/news\/2026\/02\/04\/us-trump-administrations-pervasive-attacks-on-rights\">Human Rights Watch<\/a>, and many other refugee rights organizations who support a sacred moral and legal right for people to seek asylum as recognized under international and domestic laws.<\/p>\n\n\n\n<p>Professor James C.
